"This is a clear victory ... This is a significant amount of money that will help her for the rest for her life," says the attorney who represented a mother whose baby was decapitated at birth. The mother, Micheatria Donelson, won roughly $1.4 million in a suit for medical malpractice, according to AZ Central.
Donelson's attorney argued that his client had post-traumatic stress disorder, as well as depression and anxiety, after the incident.
Though defense attorneys said that the incident "could not have been predicted or prevented by nursing care" - the jury ultimately did not hold the nurses or hospital liable - Donelson (through her attorneys) presented evidence that her baby might have been decapitated because the doctor failed to remove a string-like object that keeps the cervix closed.
The string, in turn, may have acted like a noose on the baby's head and neck as the doctor attempted to pull the baby out.
