It's that time of year when most of us force ourselves to get through the hassle of shopping in overcrowded stores. People are either moving too slowly or being too pushy. Maybe their shopping carts are blocking an aisle or being annoyingly squeaky.

Or, as in the case of one Texas woman, maybe a cart completely and unexpectedly crashes into you and runs you over. In fact, the plaintiff says that an entire row of shopping carts ran over and injured her while she was shopping at a Sam's Club in 2009.

According to The Southeast Texas Record, the personal injury victim is suing the store for negligence regarding the following:

  • operating the shopping cart train at an excessive rate of speed
  • failing to keep a proper lookout
  • failing to operate the shopping cart train in a safe manner
  • failing to make timely application of its braking system
  • failing to have appropriate safety policies and procedures for the operation of shopping cart trains
  • failing to provide appropriate instruction to employees regarding safe operation of the shopping cart trains

She reportedly wants a significant amount in damages due to the physical pain and injury caused by the negligence of the store and its employees. Requested damages would also serve to pay the victim's medical bills and make up for the stress incurred by the avoidable incident.

We will post an update in this premises liability case when more details develop. But for now, this is a safety reminder. That last-minute run to the store for a forgotten holiday gift that you might be preparing for should be approached with caution. It's busy out there, and, unfortunately, not everyone operates with the proper level of responsibility.
